Action Seeks to Halt "Low" San Gabriel Dam

LOS ANGELES, Jan. 5.—Appearing in support of an application for a court injunction against the erection of a "low dam" in the San Gabriel canyon, counsel for property owners charged in superior court today that the board of supervisors were not justified in their decision.

In addition to opposing the "low dam" ordered by the board in May, 1927, attorneys James Anderson and Walter Haas sought the approval of the court on an application for a contrary injunction directing the supervisors to build a "high dam."

According to the attorneys representing the San Gabriel Valley property owners the board of supervisors had before it no evidence of a change of position which would justify them in going against the wishes of the taxpayers as expressed in the $35,000,000 bond election in May, 1924.

The proposition then advanced by the people according to the attorneys, called for a high dam, 425 feet in height with a storage capacity of 240,000 acre feet.

The case for the low dam was to be presented in court later in the day by the California Taxpayers Association, which has asked for an injunction against the high dam.

The association contends that the supervisors had ample justification for deciding to build the low dam in the report submitted to them by a consulting board of engineers.

As the supervisors stand at present they are committed to a high dam, having voted in August to build the larger structure by a vote of 3 to 2.

Supervisors Sidney T. Graves and Jack Bean contend, however, that any storage behind a dam higher than 385 feet would be uneconomical.
