High Court Rules In "Bad Dog Case"

TALLAHASSEE, Fla. - (INS) - The Florida Supreme Court ruled Tuesday that when a person is bitten after ignoring a "beware of the dog" sign he has no right to expect to collect damages.

The decision overruled an earlier judgement by the Dade County Circuit Court which awarded $3,500 damages to S. Barr Berman of Miami Beach.

Two bulldogs belonging to a Miami man bit Berman, but the dog owner claimed in his appeal he was not liable because signs warned of the dogs' bad tempers.

The High Court concurred by a vote of six to one. One of the concurring justices, John Dickinson, admitted that the law was a "bad law from strictly a legal standpoint," but said the suit did not question the constitutionality of the law.
