The Demerit System

Announcement that tentative passenger car rates for 1956 compulsory automobile insurance will be supplemented by $6 per demerit point for car owners, arouses public interest again on what violations provide what Demerits. Here follow the official penalties;

12 POINTS EACH FOR:
At fault in causing fatal injury.
Operating under influence of liquor.
Permitting intoxicated person to operate.
Using motor vehicle in the commission of a felony.

8 POINTS EACH FOR:
Failure to stop after knowingly causing bodily injury.
Operating recklessly or so as to endanger.
Operating uninsured or unregistered motor vehicle.
Racing (or operating on a bet or wager).

6 POINTS EACH FOR:
At fault in causing serious bodily injury.

4 POINTS EACH FOR:
Allowing improper person to operate motor vehicle.
Exceeding established speed limit.
Failure to stop for blind person,
Larceny of a motor vehicle.
Loaning license.
Operating after suspension or revocation of registration.
Removing or defacing engine or serial numbers.
Using a motor vehicle in the commission of a larceny.
Using a motor vehicle without authority.

3 POINTS EACH FOR:
At fault in causing minor bodily injury.
Failure to stop for school bus.
Operating in violation of restrictions on license.
Operating without inspection sticker.

2 POINTS EACH FOR:
At fault in causing property damage in excess of $100 to any one vehicle of other property.
Attempted larceny of motor vehicle.
Failure to file report of accident.
Failure to heed stop sign.
Failure to signal change of movement.
Failure to slow down for pedestrian,
Failure to stop after knowingly causing property damage.
Failure to stop for traffic control signal.
Improper passing.
Operating with improper brakes.
Speed too fast for conditions.
Uttering false statement on application or to an officer.
Violating law of the road or established rules and regulations.

1 POINT EACH FOR:
All other violations except parking violations, but including operating motor vehicles with improper equipment other than brakes.

When a driver accumulates eight points in a 365-day period his driver's license is subject to suspension after a hearing before a hearings officer. Upon accumulation of 12 points in such a period a car owner's registration is subject to suspension after a hearing.

In addition, a driver may lose his license or registration upon accumulation of eight points for a series of smaller offenses within a 365-day period.

Upon accumulation of five points a driver receives a written warning from the registrar of motor vehicles, calling his attention to the possibility of losing his driving privileges if he piles up a total of eight points. Some drivers are also called into a registry conference at this point.

In all cases, when a driver is notified of points assessed against him, he has 21 days to appeal. If he appeals his case is reviewed by an appeal board.
