Will Not Appeal.

While the trial of Biscoe, for the murder of Hayden, was in progress during last term, the counsel for defense took exceptions to the rulings of the court with the intention of carrying the case to Court of Appeals in the event of conviction, and after the verdict of guilty had been rendered by the jury counsel gave notice that an appeal would be taken. The Circuit Court, however, failing to receive his fee of payment from the counsel, did not make up the record of the case for the Appeals, as he is not required to fix up the papers unless the charges are paid. Last week Mr. Turner, the clerk, received a communication from Mr. Camalier, one of counsel for defense, that they had concluded to abandon the appeal, as they could not see that the result of a second trial, even if one was granted by the Appellate Court, would be different from that already rendered. This, therefore, finally disposes of this case so far as adjudication is concerned, and nothing now remains to be done to satisfy justice in this case save the sentence of the court and the execution which will necessarily follow. It is generally thought that Biscoe will be sentenced at the approaching February term of court. After the sentence the date of execution will be fixed by the Governor. - Port Tobacco Times.
