HITS SENTENCE OF 2 SOLDIERS

Washington, Nov. 1.-Rep. Vito Marcantonio (ALP, N. Y.) has written Undersecretary of War Robert P. Patterson asking for an audience at which to present an appeal for two Negro soldiers who were convicted of rape in Noumea, New Caledonia, and sentenced to dishonorable discharge and life imprisonment. The two men, Frank Fisher, Jr., and Edward R. Loury, are confined at McNeil Island, Wash.

Marcantonio wrote Patterson that he had made a thorough examination of the records in the cases of the two convicted privates and was convinced that "these two soldiers were not guilty of the crime charged and that their conviction was a gross miscarriage of justice influenced by the race of the accused."

The letter points out that a review of the case was conducted by the Judge Advocate General's office at Melbourne, Australia, and by the commanding officer in that theater. For this reason, Marcantonio says, he was informed the next appeal should be made to the Adjutant General acting under the direction of the Undersecretary of War.
