The New Jersey Case.

Truth and justice have at last prevailed; the most desperate efforts of a most desperate party have been signally and nobly baffled. The House of Representatives by a vote of 111 to 91 have declared that the five Democratic applicants received the greatest number of lawful votes and are entitled to their seats in the present Congress. What must the honest people of the country think now of the exclusive pretensions of the Opposition party and press to truth and patriotism? Oh, they said, Governor Pennington's certificate and broad seal settled the question! The "Whig" claimants must have their seats. T'was impudence, audacity and very stupid ignorance to say aught against it.

Well, the Democrats thought otherwise some well meaning "Whigs" thought otherwise, A Committee on Elections examined testimony and reported; speech after speech was made, the whole country was agitated with the terrible thunderings of "Whig" oratory.—Days, weeks, months of the public time were consumed, and at last, by a large majority, the Governor's broad seal certificate men are told that their opponents have received "the greatest number of lawful votes!" And are entitled to their seats in Congress!

We cannot but regard this as a gratifying triumph of common sense and truth, over technicalities and party management. Many of the "Whig" members declined voting perhaps from shame, perhaps from fear. All unbiased minds cannot but admire the magnanimous and independent course of Messrs. Fisher and Shepard, of N. C., Lewis of Alabama, Pickens and Rhett, of S. C. and others who have of late declined co-operating with Whig tacticians.
