WASHINGTON—(FP)—NLRB Gen. Counsel Robert Denham won over the five members of the board last week to his view that the Intl. Typographical Union (AFL) has refused to bargain in good faith with U.S. publishers.

Last Dec. 9 at Indianapolis, NLRB Trial Examiner Arthur Leff dismissed the charge of refusing to bargain in good faith at a hearing on a complaint by Denham in the case filed by the American Newspaper Publishers Assn.

Leff held that the publishers brought their action under the wrong section of the Taft-Hartley act and Denham appealed to the full board.

In upholding Denham, the NLRB itself said that it was not ruling on whether Leff was legally right or wrong in his decision, but was restoring the refusal to bargain charge in order to hear the facts.

Gerhard van Arkel, former NLRB general counsel, who is acting as attorney for the ITU, took quick exception to the NLRB's action. He said it was "certainly irregular" for it to reach a decision without giving the union a chance to be heard and submit briefs.
