Question of Green Street Extension and Vacating Land Before the Committee

WOODBRIDGE, Dec. 2.-Two matters affecting the Rahway avenue situation received the attention of the township committee at its meeting last night. The first was the extension of Green street across the property of the Morris estate and suit to restrain it from vacating. Second, the suit against the township read in favor of the Woodbridge Lumber Company. An ordinance was introduced for a sewer in Wedgewood avenue, bids received for coal and a complaint made about the deplorable conditions of a road in the Iselin section.

A map was filed showing the extension of Green street, across the Morris estate which will open up many lots that are now cut off from the main thoroughfare. It is the desire of the committee to straighten Rahway avenue in connection with the extension of Green street and to take out an offset in the avenue which will be caused by the Green street extension. In order to remedy this condition, the committee will make a personal inspection of the thoroughfare next Monday.

Township Attorney J. H. Thayer Martin gave a lengthy report on the status of the suit in the supreme court begun by Peter Greiner to restrain the township from vacating land in Rahway avenue in favor of the Woodbridge Lumber Company.

In telling of the case Mr. Martin answered an attack made in a local newspaper concerning the vacating of the land.

Mr. Martin explained that Mr. Greiner through his attorney, Mr. Cutter, obtained a writ to show cause why the suit should not be started to compel the township to retain the property. The matter was heard before Justice Samuel Kalisch but as Mr. Cutter was not prepared to proceed with the case, it was agreed that a brief be filed by both sides. Mr. Martin pointed out that Mr. Cutter had failed to file his brief until the last time of the time allowed for the filing of briefs and for this reason he has been unable to even so much as look at it. The brief, Mr. Martin informed the committee, should have been filed by Mr. Cutter at least ten days before it was. The vacating of the property in the interest of the lumber company will straighten the company's line and provide a means whereby the proposed trunk line sewer can be laid down the bed of a brook that runs through the lumber company property.

Mr. Martin then said he moved to have the action dismissed, but on the plea of Mr. Cutter that the case go over until the next term of court Justice Kalisch so agreed, and issued an order to that effect. The briefs are now on file in the supreme court and Mr. Martin was of the opinion that it would only be a short time before the committee would learn whether or not Mr. Greiner can bring the suit he contemplates.

The Taxpayers Association of Iselin through their secretary, D. F. Gallagher, complained about the deplorable condition of the road across the Star Eagle property. The road is about impassable, it has pointed out, and although a little work had been done on it before election it has not been touched since. The matter was referred to the road committee.

An ordinance to extend the Wedgewood avenue sewer was introduced and passed on first reading. The ordinance will be given its public hearing on December 15. The ordinance calls for the expenditure of $2,000.

Bids were received for 100 tons of coal and referred to the committee of the whole. They follow:

Warr Coal Supply Company, $13.25 per ton; T. J. Dunigan, $12.75 per ton; T. A. Leiber, $13.25 per ton; Maurice P. Dunigan, $14.00 per ton.

The following low bidders were awarded the following contracts:

Hagerman Heights sewer, Peter Peterson; Avenel Garden sewer, J. W. Rohr; Tappen street sewer Fords Construction Company; Fifth avenue improvements, Avenel, Ford Construction Company; Third street, improvements, W. C. Smith; Fourth street, improvements, W. C. Smith.

The Benjamin street sewer and grade was rescinded.

The following inspectors for the above work were appointed: Fred Leidner, F. Johnson and T. G. Sullivan.

Due to illness Louis Neuberg was unable to be present at the session.

The next meeting will be held on Monday afternoon.
