A 19-year-old youth went on trial for his life Tuesday on a charge of raping a 13-year-old girl in a wooded section behind the Anderson Park School.
The youth, identified as Charles Edward Rainey, of 240 Wadley St. N. W., was tried in the Fulton Superior Court of Judge E. E. Andrews on a bill of indictment charging him with the September 20 criminal assault of the girl.
The girl told the court she was attacked at approximately 3:55 p. m. as she was on her way home from school. She said the youth "jumped up out of the woods and asked me to go home with him."
The witness said Rainey had a pistol with which he threatened her life. After she refused his advances he threw her on the ground, the girl said. During the attack the girl said she saw three girls walking down a nearby path. "I called for help," the girl declared.
The girls stopped for a second and then "they started running."
Rainey denied attacking the girl and claimed he never visited the spot where she claimed the attack took place.
The trial was a legal duel between Attorney Reuben A. Garland who acted as special prosecutor, and Louis LaMair who conducted the defense.
Rainey was arrested by Detectives Howard Baugh and C. J. Perry. Baugh testified that he arrested Rainey in connection with the assault, and the girl identified him.
