Treadwell for the use of Watsons vs. Thomas Bladen.
Action for damages for infringing plaintiff's patent right in machinery, for improving the manufacture of sugar biscuit and crackers; commenced last September, and tried the 26th May in the Circuit Court of the U. S. before Judges Baldwin and Hopkinson, and a very respectable special jury. The machine consists of seven circular knives in circular connexion, with niches to unite the biscuit, so as to handle seven at a time, and holes for the refuse dough to pass away.
The defendant denied that his similar machinery infringed the plaintiff's because the former is without the same attaching niches, the holes for the refuse dough pass it down instead of up, and the cutting is done like shears instead of a knife.
Several scientific and practical mechanics were examined as witnesses, and the argument was conducted by Messrs. Ingersoll, sen. and Chas. Ingersoll for the plaintiff, and Mr. Ingraham for the defendant.
Judge Baldwin instructed the jury that the patent was established, if the witnesses were believed; and left it to the jury to assess what damages they thought proper, as actual, not vindictive reimbursement to the plaintiff for what he had suffered by the defendant. The jury, after a short retirement, gave their verdict for $400, which being trebled as the law directs, makes the sum of $1200 for the infringement complained of.
