Echoes of a divorce suit from a former wife were the cause of the temporary aggravations of Frank Matthews at Lordsburg on Wednesday. The complications grew out of a check which Mr. Matthews says was issued on the understanding that it was to be paid if he obtained the custody of a 3½ year old son when the legal issues were finally adjudicated July 19. When that day arrived, Matthews says he won all the issues of the case except the custody of the child and because of that fact he stopped payment on the check. That resulted in a complaint being lodged with the sheriff at Yuma and a call coming to Douglas to locate Matthews.
Matthews was located at Lordsburg by the sheriff there and taken to the office but when he had told his version, Yuma was advised and upon inquiry the sheriff at Yuma discovered, according to Mr. Matthews, that the action was one that would have to be determined in a civil suit and not a criminal action and he at once advised the sheriff at Lordsburg to release Matthews. This was done.
Matthews and his wife returned to Douglas Wednesday night and yesterday he gave his version of the affair. His statements as to what happened at Lordsburg are confirmed by the sheriff there, who told the Dispatch yesterday that the sheriff at Yuma, when asked about the case said to release Matthews.
