A suit has been filed in the district court by H. H. Rutherford against the Union Land and Cattle company seeking to secure the reward of $2,500 which the company offered for the capture or death of L. W. Fristoe and J. W. Bell following the shooting of St. Clair and Requa near Deeth in February.
Rutherford is said to have been an acquaintance of Bell's, and when Bell left Fristoe in the engine pit in East Ely he went to Rutherford, who contends he advised Bell to give himself up to the sheriff and also to tell him where Fristoe was in hiding. This Bell did, and Rutherford claims that he was responsible for the capture of Fristoe and the surrender of Bell.
The complaint filed by Rutherford, through his attorney, C. E. Handwright of East Ely, contains a copy of the notice of reward offered by the cattle company, which contains the clause that there were "no strings on the reward."
He also asks for costs of the suit.
Rutherford is employed in the shops of the Nevada Northern railway.-Ely Times.
