ARIZONA OPPOSES CONSTRUCTION OF BOULDER DAM

Peterson Files Briefs Attacking Validity Of Contracts.

WASHINGTON, July 29. (U.P.)-

Arizona will carry its fight against construction of Boulder dam to the U. S. supreme court if necessary, K. Perry Peterson, Arizona attorney general, intimated here today.

Peterson already has executed the first move in the state's fight, filing of a brief with Comptroller General McCarl attacking validity of contracts made by the government for sale of power generated at the dam.

Although reluctant to discuss future action, in case McCarl upholds legality of the contracts, Peterson said a suit would be instituted "in the proper court" to halt work on the dam until Arizona's demands are met. The suit would have to be entered in the U. S. supreme court inasmuch as the case is an original litigation between states.

In its brief protesting the power contracts, Arizona asks the comptroller general to withhold payment of the $10,660,000 appropriated for starting work on the dam. The state contended these contracts fail to insure the government replacement of costs of the dam's construction because one of the contractors, the city of Los Angeles, under its charter, can be bound to pay only to the extent to which funds are available in its treasury.

Another action contemplated by Arizona, if the contracts are held valid, is the filing of a suit in Arizona courts for an injunction prohibiting government engineers and laborers from entering the state to begin work on the dam. Peterson denied anything has been done on the dam, despite formal announcement by Secretary of Interior Wilbur that work was begun immediately after President Hoover signed the second deficiency bill providing funds for construction.
