Plaintiff Loses
In Mortgage Case

Failure of Arthur Fuller to file an amended complaint within the time specified by a court order upholding a defendant's demurrer yesterday afternoon resulted in a judgment in favor of Sue Hartwell and the Los Angeles National Trust and Savings Bank against Fuller.

Fuller, in his complaint, had asked that a mortgage held by the bank be set aside in favor of a claim established by himself by an earlier court judgment. Judge Thompson had upheld a demurrer by the defendants, giving Fuller a certain time in which to file an amended complaint.

Failure to do so resulted in a judgment dismissing the action.
