The slot machine in Nevada was doomed to go the way of the saloon yesterday when, in an opinion addressed to the district attorneys of every county in the state, Attorney General Leonard B. Fowler held that its operation is a lottery and that peace officers in the performance of their duties must recognize the unlawfulness of its existence.
This decision by the legal head of the state will probably do away with proposed legislation by solons dealing with the subject. It is understood that it is a harbinger of a solid lid clamping on all sorts of gambling now tolerated in Nevada.
In the opinion, Attorney General Fowler states, "Courts have decided in various cases that the operation of a slot machine is a lottery, so that question is non-debatable. From a legal standpoint it is positive that such a machine is a lottery.
"In the face of our constitutional provisions on the subject it is likewise positive that the legislature cannot pass an act which will legalize slot-machines. As law advisors we cannot construe the law so as to permit them, and peace officers in the discharge of their duty must recognize the unlawfulness of their existence."
