No action has been taken against the boomers yet. Gen. Hatch arrived here from Topeka by the Santa Fe yesterday morning and repaired to the Occidental hotel where he met Assistant U. S. District Attorney Hatton, Lieut. Day and Capt. Couch. They spent considerable time discussing the case against the boomers. All concerned expressed an earnest desire to have the matter settled for good before the time set for the next invasion of the territory.

Subsequently Gen. Hatch and Mr. Hatton went to Commissioner Shearman's office and held a consultation when it was decided to advise Couch to telegraph his counsel, Judge McDonald, of Winfield. An Eagle reporter in conversation with Gen. Hatch and Mr. Hatton last night, learned that they have not yet fully determined as to whether or not they would re-arrest the boomers just now, but that they would arrive at a conclusion in the premises to-day. Mr. Hatton said to the reporter that he would write the attorney-general on the subject to-day giving more definite information touching the territory than has yet been received at Washington. From this it would appear that the United States authorities here cannot see their way quite clear in prosecuting these men. Couch and his associates are anxious to go home but have remained in order to save the government the trouble of going after them. Gen. Hatch and Mr. Hatton, no doubt, have gathered much from the soldiers who came here to testify against the boomers, that make them reluctant to proceed in the case without further instructions from Washington. It is also hinted that United States District Attorney Hallowell will go to Washington to confer with the attorney-general on the subject.
