Editor: Due to the fact that the report of Wilson vs. Wilson
Court decision, printed in the May 28 edition of your paper, was so
incomplete, I am, hereby, submitting a full and complete report taken
from the court order signed by Judge Harold Rogers.
It is adjudged and decreed that the plaintiff (Allie E. Wilson)
and defendant (Huston R. Wilson) shall each have an undivided
one-half interest in and to the real estate property. That in lieu of
an award of alimony at the present time, in view of the plaintiff's
earnings, that she shall have as her own the 1948 Oldsmobile, and
that in addition thereto, plaintiff shall have as her own all of the
household goods, fixtures and furnishings now used by her in her
own apartment and presently in her possession in the said apartment. The court shall retain jurisdiction of the above entitled
matter for the allowance of alimony in event of a change of circumstances, and upon a proper application therefore in the future
by the plaintiff.
IT IS FURTHER ORDERED that the plaintiff shall retain
full possession of said property to the exclusion of the defendant.
She is authorized and directed to collect the rents, and out of said
rents pay for all necessary repairs and upkeep, taxes and insurance
and for replacements of personal property in rental units, and to
keep an account and record of the collection of rentals and the disbursements of said funds, including a charge to herself for the use
of her living accommodations, with a monthly allowance for management deducted. It being further provided that out of said rentals
after paying the other foregoing items, that she shall set up a reserve account of two hundred dollars ($200.00) annually to meet
other contingencies. That the defendant shall be entitled to one-
half net proceeds, that plaintiff shall retain as her own property
one-half thereof. That defendant be and hereby restrained from interfering with the plaintiff in any manner whatsoever in connection
with her management and operation of said property or rental
units. That the defendant shall pay to the plaintiff by payment to
Thomas O. Dougherty, her attorney, the sum of two hundred dollars ($200.00) as permanent attorney's fees in addition to the sums
already allowed and paid at temporary attorney's fees and suit
money.
Mrs. Wilson was represented by Thomas O. Dougherty and
Mr. Wilson's attorney was I. Howard Bennett.
