Will Contest Begun That May Prove of Importance as a Precedent.
St. Cloud, Minn., Sept. 23.-What is the commencement of long litigation began in the probate court, upon hearing proofs of will, estate of M. Julia Will, who was a sister of the Order of St. Benedict at St. Joseph. Frederick J. Will St. Paul, brother of deceased, contests the will. The valuation of the estate is about $40,000, and is located in St. Paul. M. Julia Will died in August, 1894, leaving to the Sisters of the Order of St. Benedict in St. Joseph, Stearns county, all her real and personal property, and her mother, Prioress Alaysia, was appointed sole executrix.
Contestant alleges that the deceased was not a free moral agent of sound mind, but was by reason of religious obligations obliged to make the will. and that the deceased was unduly influenced by her vows and obligations. He denies that the will was subscribed and attested to in her presence and alleges that the names of the witnesses were subscribed after the death of the testator.
