The Spirit of the Times contains a report of a case before the Mayor, in which a worthy citizen, a mechanic, was called up for a breach of the peace. He had flogged a man in Franklin Square. The gentleman, (we mean of course, the mechanic,) was sitting with his wife and children on a bench. enjoying the evening breezes. and the fine appearance of the fountain, when another person, with a female, came and sat down on the same bench, and began to use language grossly indelicate. This led to remonstrance, and at length to blows, in which the offender was soundly thrashed. On Saturday morning both appeared before the Mayor, The story was soon told. His Honor agreed to hold the mechanic's case under advisement, and bound over the young man to keep the peace. Durney Jumped up, looked his Honor in the eye, and with the most unblushing impudence. demanded, 'what do you call breaking the peace sir?'

"I'll tell you,' said his Honor, 'When the virtuous wife of a worthy mechanic cannot go into a public square to inhale the pure air of the evening, without having her ears polluted with the obscene language of a -- and her paramour. That's what I call breaking the peace! '
