James Hinton has sued the Louisville and Nashville Railroad Company and the Western Union Telegraph Company for $50,000 damages. From the declaration filed, it appears that the plaintiff claims he was a brakeman on this railroad; that a telegraph pole leaned from its position till it nearly touched the cars in passing, and that it had, to the knowledge of the defendant, been in that condition more than two weeks; that he was in the habit of passing that place on the trains in the night, and knew nothing about the condition of the pole. He claims that he was climbing the ladder in order to get on top of the car, and, while in that act, the train passed the pole, which knocked him from the car, broke his leg and thigh, fractured his skull, and made him a cripple for life.
