GALLUS BREAKS AND MINER IS HURT

(From Tuesday's Daily.)

A button must have come off while Harry Gilmore was standing under the "gallus" frame he was working to build at the Kay mine. According to a complaint filed yesterday, a timber fell off the "gallus" frame and struck the plaintiff, injuring his head and shoulder so severely as to incapacitate him for further work in his vocation.

The plaintiff alleges that he was exercising all due care and caution and that it was not his fault that the suspenders broke or slipped and let the log fall on him. He is asking $30,000 damages through his attorneys, F. C. Struckmeyer of Phoenix and R. B. Westervelt of this city.
