It is not pretended that any security was given for any part of the money taken by Mr. Weller, until the first of February last, after his nomination as a candidate for Governor. Even his official bonds cannot now be found: and the largest and most valuable part of the property (the farm of 150 acres,) included in the mortgage by which it is pretended that the $11,000 of this fund is secured, was a few days ago sold at sheriff's sale, for the satisfaction of another claim, and bid off by his brother-in-law. We are informed that the sheriff has returned the property "not sold for want of bidders."

We know that there were actual bona-fide bidders who did bid on the property. Why the sheriff has made this return we know not. It was probably a trick of Mr. Weller and his friends to keep possession of the property, and prevent the collection of the money due to the heirs, which was placed in his hands as their guardian.

We need not multiply words on this subject. The facts which we have stated are not denied. We submit them to the judgment of our fellow-citizens. We leave the people of the State to decide whether this is not a "clear and unquestionable" case of official misconduct and embezzlement.

In his answer to the bill in chancery, Mr. Weller states that in consequence of his being "unable to make out a true and accurate statement of the account of each individual indebted to said Fund, and because some difficulties were anticipated in the adjustment of the same, it was suggested that a suit should be bro't, and the accounts settled by disinterested persons; to this respondent assented and expressed his entire willingness to have the matter thus settled."

Now mark the fact—that after the bill was filed, Mr. Weller demurred, and tried to throw the cause out of court! Does this look like an amicable proceeding? does it look like a "willingness to have the matter thus settled?" "Mr. Weller says, "some difficulties were anticipated in the adjustment of the same." What difficulties could exist if Mr. Weller and his associates had done their duty? The true difficulty was, that Mr. Weller and his associates had embezzled the money and were unable to repay it. This is in substance confessed by Mr. Weller himself, in the extracts which we have copied from his answer.
