OUSTER
Proceedings Brought Against the W. & L. E. in Toledo.
Toledo, O., July 17.--If the city wins its suit in ouster to be brought by the city legal department against the Wheeling & Lake Erie railway, the latter will be forced to remove its costly passenger depot from its present site and abandon all the valuable Miami and Erie canal right of way now occupied by the company.
The suit is to be brought at the order of the city council and action will be based on the ground that the ordinance granting the company permission to use the canal bed has been forfeited by alleged non-compliance with its terms. The ordinance granting the railway this particular right of way was passed in 1881, on consideration that the company, within a reasonable time, construct, maintain and operate its repair, machine and car shops within the city limits. The company insists that it does maintain some sort of repair shop on the east side. Since 1881 the value of the land has increased wonderfully.
The suit will be filed as soon as the city engineer provides a blue print of the canal property.
