JUNEAU FEDERAL COURT
IGNORES LAST JURY LAW
That jurors in the federal court in the First Division, for the present at least will continue to be drawn under the provisions of the Territory jury law of 1925 notwithstanding the existence of a newer act, passed last spring, that repeals the 1925 statute. was indicated recently by Federal Judge Justin W. Harding, says the Juneau Empire.
Jury lists now being prepared in the office of Clerk of Court for a forthcoming term of court will follow the requirements of the old law, it was announced. Both grand and petit jurors will be drawn within a few days, and impaneled on or about October 1.
No court order has yet been signed by Judge Harding. He said that the grand jury would report for duty on October 1, and if any cases are to be ready for trial then the petit jury will report at the same time. If there are no cases ready, the petit jurors probably will report for service about October 8.
The criminal calendar is said to be limited, but there are a number of civil actions pending.
The Territorial Legislature last spring repealed the act of 1925, after a stubborn fight had been made to prevent such action. The principal change made by the new law is in the number of names to be included in the list from which jurors are drawn. Under the terms of the 1925 statute, it was optional with the clerk of court whether 1,000 names or three-fourths of the voters in the last preceding election were used. The 1931 act requires that the names of at least four-fifths of the persons voting at the last preceding Territorial election be placed on the list from which the drawings are made.
It also repealed the act of 1925.
