SINGULAR TRANSACTION.—Yesterday morning, at a very early hour, several gentlemen proceeded to the store of Geo. B. Boyle, in Broadway, near Murray street, and having forced the door with a crow bar, emptied the whole contents of the store into boxes on carts there in readiness for that purpose. The persons who did this, acted in perfect good faith for the creditors of the firm who they had reason to think were being defrauded.

The circumstances of the case are, as near as ascertained, as follows:—A lady of this city some time since advanced large sums to one of the firm, for the benefit of the store, and soon afterward some trouble occurring, he made a regular assignment of the whole stock to her, for her own benefit, as well as for that of the other creditors. By virtue of this assignment, she gave him a power of attorney, constituting him her agent, in which capacity he was to act for the joint benefit of all concerned. Shortly after this was given, it was discovered that upwards of $2000 worth of goods had been taken from the store; and sent to a merchant in this city in satisfaction of a debt. On learning this the power of attorney was immediately revoked, and the lady demanded that the goods should be delivered up to her. This was refused, and she immediately sought the best legal advice, and under that, through her instrumentality, the store was entered as stated, and the goods taken.

Another version of this singular affair, furnished by one of the parties concerned, may not be amiss.

The lady who advanced the money to Mr. Boyle, is Mrs. Munn. In August, when the late firm was dissolved, Mr. Boyle became assignee for the benefit of all the creditors, but in May, he under advice of counsel, made an assignment to Mrs. M. a creditor to a large amount and to several other creditors who were favored. Those who had not the benefit of this assignment became dissatisfied and some difficulty was likely to occur. Mrs. M. then threatened to sell the goods at auction but Mr. B. on consulting another counsel, was advised that this assignment to Mrs M. being a fraud upon the unfavored creditors, was void, whereupon he refused to deliver the goods to her, and to allow her to have any thing farther to do with the affair. Mrs. M. then acting under the advice of her counsel, employed an ex marshal, named Le Roy, and a lawyer named Cyrus M. Stebbins, who, at about 3 A. M. on Wednesday morning, went to the watch house and applied for assistance from the captain to enter the store. This he refused, but allowed any watchman to go if he thought proper. One did go and a crow bar and lantern were taken thereto assist in the operation; with this the store was forcibly entered, and $22,000 worth of goods were taken off. Mr. Boyle immediately took out a writ from the Superior Court, upon which Le Roy and Stebbins were yesterday arrested. They were held to bail in $10,000 each, which was procured, and they were discharged.—
