The courts have backed up the Ohio State Liquor Department's claim that it can not be sued in the case involving the use of the name "Duffy's Tavern" for alcoholic beverages. U. S. District Judge Robert Nevin so ruled in Cincinnati today upholding the department's that it lacked jurisdiction. The suit was filed last March by the Bank of America Trust and Savings Association of California and C. Maurice Holland of New York. It was against the State Liquor Department and The Parnell Company from using the name "Duffy's Tavern" on liquor. Those filing the suit claimed they had acquired all rights to use the name from Edward Gardner, creator of the Duffy's Tavern radio program.
