Fess Would Require Six Justices to Rule Congress Act Void

WASHINGTON, March 31.—A change in judiciary procedure requiring the concurrence of at least six of the nine members of the United States supreme court to declare an act of congress unconstitutional is advocated by Senator Fess, Republican, of Ohio.

In a letter made public today Senator Fess declared he favored modification of the present procedure by which a majority of the court may declare a law unconstitutional on the same grounds upon which he supported the provision of the Ohio constitution requiring the concurrence of all but one member of the state supreme court in a decision nullifying an act of the legislature.
