R. W. Sabin made his debut as prosecutor for the city yesterday afternoon in police court at the trial of Mrs. Freda Weber, charged by Frank McHugh with "riotous, tumultuous and disorderly conduct." The trial occupied about two hours of the time of the court and when the last bit of evidence had been introduced the newly appointed city attorney admitted that the pace set by the defendant had been too strenuous for him and that he would not attempt to argue the case.
The defendant proved a willing witness. In fact she was too willing for Attorney Sabin, who attempted to get in a question now and then while she was on the stand. Aside from her evidence, she had prepared a brief of seven pages, giving the history of her life and the details of the various fracases occurring on North Fifth street in which she had been a participant during the past sixteen years. The city attorney objected to its introduction on the ground that it was irrelevant and immaterial" and for the further reason that the witness had not been admitted to the bar and was therefore incompetent to draw up a legal document.
After considering the evidence, and consulting Officer Henry Spahn and Constable James Leary, Judge Ellis asserted that he "was up against it." He believed plaintiff and defendant were both at fault. He finally assessed a fine of $1 and costs against the fair defendant, which she will not have to pay as long as she lives in peace and harmony with her neighbors.
Constable Leary, who appeared as the official interpreter, was highly complimented by the court for his valuable services. Attorney Chas Brewster appeared for the defendant and put up a strenuous fight.
