Court Revokes Bail
Of US Red Leaders

New York (LPA)—Ten of the 11 convicted Communist leaders will have to go to jail before the end of September unless the Supreme Court allows them freedom pending further appeal. The 11th, Eugene Dennis, is already in jail under a contempt of Congress charge.

That's how the US Circuit Court of Appeals here ruled in a two to one decision on a government motion to revoke their bail. At the same time, the court declared unanimously against a re-hearing of its Aug. 1 ruling which sustained the Communist's conviction in a Federal District Court and upheld the Smith act under which they were tried.

Specifically, the court gave the 10 Communists, members of what is often called the American Polit-buro, 30 days to surrender or ask a Justice of the Supreme Court to continue bail pending appeal to the high court. Decision was handed down Aug. 28.
