Winner Shooting Scrape Brings Out Details of Peculiar Situation.
Winner, S. D., June 24.—On account of some public feeling being aroused here on the horse 'rustling' question, the farmers who employed E. R. Kindred to act as a decoy have issued a statement explaining his association with persons charged with such crimes, and exonerating Kindred from any criminal motives.
As a result of a trip made by Kindred and a man by the name of McKee, in which a horse was taken, the latter was placed under arrest and tried for the theft, but was discharged. He succeeded in making a showing before the jury that he was led into the incident and had no criminal participation in the act.
After McKee was discharged the state's attorney had Kindred arrested, but it is claimed this action is merely for the purpose of clearing the record and to show that Kindred was acting in an official capacity. The statement of the employers is to the effect that they were kept in touch with Kindred's actions.
J. W. Shevlin, editor of the Journal, was attorney for McKee when the latter was on trial and this was one of the situations leading to his personal disagreement with Kindred, and which resulted in Shevlin firing a couple of shots during a recent altercation.
