Mr. Clay submitted the following motion for consideration:

Resolved, by the Senate and House of Representatives of the United States of America, in Congress assembled, (two thirds of both Houses concurring) that the following article be proposed to the legislatures of the several states, which, when ratified by three fourths thereof shall be valid, as a part of the constitution of said United States:

ART. XIII

The judicial power of the United States shall not be construed to extend to controversies between citizens of different states, claiming lands under grants of different states; nor between a state or the citizens thereof, and foreign states, citizens or subjects.
