John W. Biddle sworn—Reside at No. 1921 Market street: saw Gribby sitting on front part of car; he attempted to spring off the car and fell under it; the two front wheels passed him, when he attempted to get up, and the two hind wheels passed over his body; assisted in getting the body from under the car.
Officer Kilpatrick sworn—Reside at No. 3 Azela street; about 5 o'clock was standing at Twenty-first and Market streets: a man told me a teamster was run over; saw cars coming down grade quite rapidly; succeeded in stopping them: found Gribby lying on a cellar-door, where some one had placed him; assisted in carrying body to Station House.
The jury returned the following verdict:—That the said Ephraim Gribby came to his death by being run over by a freight-train of cars, at Twentieth and Market streets.
