In the Berkeley Circuit Court at Martinsburg, W. Va., Judge Faulkner handed down his decision in the tax suit of the Hannis Distilling Company, of Martinsburg, against the Berkeley County Court, to compel the latter to remove from the assessment books 28,000 barrels of whiskey, valued at $200,000, which had been listed for taxation by County Assessor Ellis as the personal property of the distillery people Judge Faulkner decided that the whiskey had been properly listed for taxation and denied the appeal of the distilling company. The latter claims the whiskey is owned by other parties, non-residents of the state, and that the county has no right to assess it against the company. The case will be appealed to the State Supreme Court. The taxes involved amount to about $5,000.
