New York, Nov. 30.-(P)-Lewis H. Rothschild, vice president of the Chelsea Exchange Bank of New York, Harold Smythe, and James V. Boise, also connected with the bank, have agreed to surrender and plead to the indictment against them and others in Boston, charging violation of the prohibition laws. This was announced today after a conference between counsel for Rothschild and federal officials. By this decision the three will escape arrest and will be admitted to bail in Boston. The three men through counsel Martin A. Littleton, and A. Hardy counsel for the bank, protested that they were innocent of the charge that they, with 47 others from New York, Philadelphia, Jersey City and other cities, conspired to land between 25,000 and 30,000 gallons of Belgian alcohol from the coastwise steamer Cretan last July. The attorneys told Assistant U. S. Attorney Hubert C. Thompson of Boston and Assistant U. S. Atty. John S. Fogarty of this district, that their clients desired the Boston authorities to make an exhaustive investigation of all their activities. Thompson said such an investigation would be made. He added that the Chelsea Exchange Bank was in no way involved in the charges. Rothschild is 28 years old and said to be the youngest vice president of a New York City banking institution. Boise is assistant cashier of the bank and Smythe is secretary to Rothschild. Besides twenty persons from New York City, including the three men of the local bank six men from Brooklyn are listed among the indicted. Charles Schwartz, Charles Morrino and Samuel Lasar, are listed from Philadelphia: Frank Pool and Harry Bedell, Baltimore; Frank O'Hearon of Boston; Harold W. Beach of Winthrop, Mass.: Samuel Sakol, East Liverpool, Ohio: William C. Price of Norfolk, Va.; Morris Rotman, Providence, R. I.; Charles C. Kniffen, Jersey City; and William Taten of San Francisco. Eleven men are indicted from Hoboken, N. J., listed as Arnold Lumbeck, Gus Jergensen, Philip McIntyre, John Aron, Albert Johnson, Frank Miller, John Phingst, Frank Teassin, Gus Schildt, Otto Mentall and Chris Werner.
