Full Text

The Constable Law. This law, which the nominals undertook to repeal, we are told had its origin in Grafton County, and was projected by a member of the party that made the push to overturn it. The sheriff business had been so 'regulated' in that county, that it came to be a mere family matter, and the number of deputies was kept so small that it was necessary, in one or more instances, to send an undue distance to procure an officer. The Legislature of 1846, therefore, passed the law empowering towns to elect constables, and authorized them, upon furnishing a bond to the amount of $300, to serve writs and other processes.

No objection could be made with reason against the law, unless that the bonds were too small; but that was not the motive by which the Radicals were moved to repeal it. The law should and will be sustained, whatever the political complexion of future Legislatures. It is democratic in its character, and no man friendly to letting the people do their own business in their own way, will ever again attempt to revoke it.

Story Details

The Constable Law originated in Grafton County due to limited sheriff deputies making it a family matter and requiring long distances for officers. The 1846 Legislature passed it to empower towns to elect constables with $300 bonds to serve processes. Radicals sought to repeal it not for bond size but other motives; it is defended as democratic and should be sustained.
