At the late session of the legislature of Tennessee, a committee was appointed to enquire into the conduct of Joseph Anderson, Esq. a senator from that state, in respect to the discharge of his representative duty, who reported the following resolutions:
1st. Resolved, That this general assembly do highly disapprove the conduct of the said senator, in relation to the aforesaid subject.
2d. Resolved, That in this solemn expression of the opinion of this general assembly, it is the bounden duty of the representatives, of the people to conform to the opinions of their constituents, when fully comprehended: and when such representative, at the time, and prior to his election, induced a belief he would so act; and more especially, when the conformity with the opinion of the constituents required neither a violation of the constitution, nor the commission of an act of moral turpitude.
3d. Resolved, That no man ought, hence forth, to accept the appointment of senator of the United States, from Tennessee, nor continue to hold the same, who doth not hold himself bound to obey the will of his constituents.
4th. Resolved, That in the opinion of this general assembly, said senator will not be desirous further to represent a people to whom his services are unacceptable; and that said senator will not feel any pleasure in representing the citizens of Tennessee, contrary to their wish, and in opposition to the will of this general assembly, who elected him senator.
Lastly, Resolved, That the Executive be requested forthwith to transmit a copy of the foregoing preamble and resolutions to each of the senators in congress from this state to the executive of the United States, and each of the executives of the several states.
