BEAVERS FIGHTING.

Has Now Resorted to Habeas Corpus Proceedings.

New York, October 6.—George W. Beavers resorted to habeas corpus proceedings today to ascertain whether the government was not exceeding its authority in causing indictments to be returned against him in two separate federal districts.

Beavers was first formally surrendered by his bondsman to a United States marshal.

Lawyer Seabury, representing Beavers, then applied to Judge Holt of the United States District court for a writ of habeas corpus on the ground that it is impossible for the government legally to remove Mr. Beavers to two separate districts at the same time and that the hearings can be legal in but one case—that of the first indictment found in Brooklyn. Judge Holt made the writ returnable October 9, and fixed the bail, pending the hearing of the writ, at $2500, which was furnished.
