On Thursday, the legislature proceeded by joint ballot of both houses to the election of a governor for this state for one year. The first ballot stood thus:
George W. Smith, (the lieut. gov.) 98
James Barbour, (speaker of H. of D.) 97
Scattering
Mr Smith not having a majority of the whole, second ballot took place, which terminated in favor of Mr. S.—Smith 100, Barbour 97.
Yesterday, the legislature appointed two Judges of the Court of Appeals—Judges Cabell and Coalter. (now sitting in the Court of Appeals under an executive appointment) and Judge White (of the General Court) were in nomination. On the 1st ballot, Cabell had 93, White 87, and Coalter 18. The last being dropt by a rule of the house, the ballot gave Cabell 102, White 94, scattering 3. Of course Cabell was elected.
On the 2d ballot Coalter was elected—the votes being for him 105, for White 94.
