A Real Remedy for Real Wrongs
A number of prominent members of the bar have undertaken to arouse the profession generally to the dangers that menace the country through the "pernicious doctrines of the recall of judges and the recall of judicial decisions." In a public statement they say: "It is high time that the lawyers of the United States, who have in the past been leaders of public opinion, should indicate to the people their views and feelings on this subject."
They have well said it is high time. It could even be said with justice: "it is nearly too late." If the conservative press, guarding the established process of justice, had not been beforehand with them, they would have had the issue precipitated upon them long ago.
In no small measure these self-same eminent lawyers are themselves responsible for the widespread agitation that now frightens them. The law's delay and uncertainty, the endless granting of appeals upon appeal, the distortion of the plain meaning of law into an unintelligible maze of technicalities, the not infrequent corruption of witnesses or of juries, and all the thousand abuses of court procedure, have been known for years. No less a person than President Taft himself has borne witness to them. But what have these eminent lawyers done about it?
The demand for recall of judges is an effort to right gross abuses by methods of ignorance. The methods are bad. But the wrongs are there. And there must be a remedy--New York World.
