WIECHERS TO HOLD HIS BAIL BOND

Judge Connolly Vacates Order of Forfeiture, But Defendant Must Pay Costs of Court.

Judge Connolly, Wednesday morning, rendered a decision in the matter of the forfeiture of the $10,000 bail bond of John W. Adams, alias Anton (Wolf) Wiechers, convicted on a charge of ill-using Rosa Renz, a pretty Kentucky girl. The court decided to annul the order of forfeiture and to return the money to Adams, who is now spending a five-year term of imprisonment at Marquette.

The court's decision is as follows:

"In this case, the defendant moves the court to set aside its order forfeiting his bond and to enter an order remitting the avails of said bond to his bondsmen.

"The facts are:

"The defendant is now in the branch of the state prison at Marquette under a sentence of five years at hard labor.

"On the day before the time expired within which the defendant or his bondsmen might show cause why the bond should not be forfeited, the defendant voluntarily came from New York to Detroit. It is reasonable to assume that he made this long journey back to this jurisdiction in order to comply with the conditions of his bond. If he was seeking to escape, he would hardly have come to this city from a great distance.

On the day before the time expired in which he might give himself up, the police arrested him. It is now claimed that because the police arrested him before he got to the police station, he ought to lose the avails of his bond, viz., $10,000.

"I must dissent from this contention. The state has the body of the defendant in prison, visiting upon him the extreme penalty with which the law punishes his crime. The administrators of justice owe it to the administration of justice to save it from every appearance of vengeful persecution. Even Adams is entitled to fair play. Justice owes that to itself—not to Adams.

"The county of Wayne has incurred some small expense in corresponding with the defendant and investigating his whereabouts. The prosecutor will file an itemized bill of such expense with the clerk of this court. The order of forfeiture is hereby vacated, and the clerk is directed to refund to the bondsmen of this defendant, the avails of said bond, less the amount of the prosecuting attorney's expenses in the matter."
