There was no session of this Court on Tuesday last, but one of the judges being present. Several gentlemen from a distance who had business with the Court on Tuesday were compelled to return home without having their business attended to. This is a grievance of which they have a just right to complain. We do not wish to be understood as casting any reflection on any member of the Court, but at present, if either Judge Forrest or Cole is detained at home, there can be no Court. The fact is, the protracted indisposition of Judge Spalding makes the appointment of another judge absolutely necessary for the public convenience, and, though a member of the American party is likely to receive the appointment, nevertheless, the public interest should not be made to suffer from any more partisan consideration.
