SAN BUENAVENTURA, April 5.—On the opening of the Court, at 2 P. M., on motion of the prosecution, the Court adjourned to the Palace Hotel, to take the testimony of N. H. Hickerson, who was too ill to be brought into Court. The prisoners and counsel accordingly removed to the Palace Hotel. N. H. Hickerson, being duly sworn, said, after the usual preliminaries: "Two nights after the murder I was applied to to act as a guard, Sprague seeming to anticipate that a mob from Ventura were coming to hang him. While on guard together he told me that he had assisted in the murder, and that Curlee, Jones, McCart, Swans on, Churchill, Cook and Floyd were present. He gave me the whole particulars. He said that More, when shot down and when the crowd ran up to him, said: 'For God's sake don't kill me! You see I am shot.' Sprague said, 'Damn you, take that,' and fired the bullet into his brain."
At this point the attending physician insisted that the witness, who was so weak and sick that he had to be stimulated while giving his evidence, was too ill to proceed further, and the direct examination was resumed.
An adjournment was then had to the Court House, where George Ferguson, who was employed at the ranch at the time of the murder, was sworn. His evidence did not vary any from that given at the inquest. He saw four men surrounding More and some of them shooting; could not identify any of them as they were disguised with cloths drawn over their heads.
The defense did not cross examine this witness and at the conclusion of his testimony an adjournment was had until Saturday.
Evening: 8:30—The Court announced that in future, unless for cause shown, evening sessions would be held.
The prisoner Churchill, being very ill, has been removed to one of the rooms of the Court House, where he can be made more comfortable. Last night he was taken with spasms so severe that his life was for a time considered in danger.
