On Wednesday last, in the afternoon, before the Supreme Judicial Court, sitting in this town, came on, by review, the trial of the action brought by Mr. John Murray against the first parish in Gloucester, for the recovery of Monies due to him as a public Teacher of Piety, Religion and Morality, and which had been taken by distress from certain persons, hearers of Mr. Murray, in order to be applied to the support of the Minister of the parish. The Counsel were, Mr. Sullivan and Mr. Hitchbourne for the Plaintiff. Mr. Parsons and Mr. Bradbury for the Defendant. The pleadings were finished on Thursday evening, when the Judges delivered their respective opinions of the case, as founded upon the third article of the Bill of Rights, and committed it to the Jury. At ten o'clock the next day, they came into Court, when the Foreman declared, that they could not agree upon a verdict; on which the Court referred the decision of the cause to the next term.
