JURY HOLDS MAK NOT GUILTY: OUT JUST 2 MINUTES
[SPECIAL TO THE TIMES]

CROWN POINT. Ind. Jan 20-Establishing a record for speed in disposing of a criminal case, the jury yesterday after deliberating only two minutes brought in a verdict of not guilty for Peter Mak Jr of West Hammond. who was on trial charged with the murder of Texas Miller of Hammond.

The killing occurred early one morning last summer at the rear of the Union lunch room on Sibley st. Hammond where Miller was employed as cook. Miller had been struck on the head with a piece of iron pipe and was found unconscious by other employes of the restaurant It developed that Mak and another man had been collecting garbage in the alleys and had attempted to take some from containers at the rear of the restaurant.

It was shown at the trial that Miller had ordered them away. threatening the men with a knife. It was said that he pursued them. swinging a shovel and that Mak threw the wagon stake at him in self defense. as he drove away. He was not aware that Miller had been seriously hurt until he was arrested that evening.

In court Mak told a straightforward story and was able to show a clean record in the past His wife and several small children were in the court room lending a pathetic feature to the case Court attaches credit W. J. McAleer. attorney for the defense with making one of the most ardent pleas of his career Tears rolled down the cheeks of the majority of the jurors and as they left the room the verdict was foretold by many who were present. In just two minutes they were back with the verdict of acquittal
