H. A. Lemmon, president of the state council of defense, wired Judge Mark R. Averill, director of the Nye County Council of Defense, the following:

"Well, boys, the fight is on. Hearst has applied in the federal court for an injunction against our order. Hearing is set for October 4th. The court said the council of defense is a government agency and refused an injunction or restraining order until after the hearing. The latest war news is that Bulgaria has quit and Turkey is expected to quit any minute. This, with Hearst, makes three down. Set 'em up in the other alley."
