Federal Judgeship 'Political Trick'

Four Names Are Submitted To Washington

NEW YORK.-(ANP)-Was the promised appointment of a colored man to a federal judgeship in New York a political trick to win support for Mayor O'Dwyer's Tammany purge? With the first announcement of this plan nearly two months old, there is a stalemate in which the colored candidates mentioned in the first flush of the story, have been left to sweat it out.

Beautifully timed -- when the mayor was entangled in a preliminary bitter struggle to oust entrenched Tammany leader-the announcement was a political atomic bomb. O'Dwyer was acclaimed for his liberality and colored leaders began flocking to his bandwagon.

O'Dwyer carefully camouflaged his actions by saying the directive originated in Washington -that high party officials had requested the names of four men who could be considered candidates for the post, vacant through the death of Judge Samuel Mandelbaum.

Now Washington has denied any part in the planned appointment and O'Dwyer having won his fight against the triumvirate that controlled Tammany, has turned the matter over to his personally appointed leader, Frank J. Sampson. Indications are that the idea was purely of local origin, and the Washington ruse thrown in to make it look like a national figure was interested in the appointment of a colored federal judge.

Democratic party officials in Washington admit that the vacancy is to be filled, but their preference would be a man from the long list of Jewish lawyers and judges submitted by other leaders, rather than from the four colored men.
