NEW BONDS TO BE FURNISHED

Attorney General Martin Writes That Hold-over County Officers Must File New Bond.

If the recent ruling of the attorney general is accepted at its value, all the county officers in the state who hold over this year on account of there being no election, will be compelled to give new bonds. This will include every county officer above the township officer.

The matter was brought to the attention of the attorney general in a communication from the county attorney of Hall county, Nebr., and the opinion which followed was mailed to all the county clerks of the state for the information of the various offices.

There are in the neighborhood of two thousand officers who will be affected by the decision of the attorney general and who will have to procure new bonds as soon as their hold-over term commences. In his opinion which has been received by County Clerk Penrod, the attorney general says, "that where the bond expressly provides it shall run two years, or until the successor is duly elected and qualified, such bond would continue in force until the officer had served his full term as well as the hold-over term."

"But in view of Section 17, Chapter 10, Compiled Statutes of Nebraska, which among other things provides that when it is ascertained that the incumbent of the office hold-over, by reason of non-election or non-appointment of a successor, he shall qualify anew within ten days from the time his successor, if elected, should have qualified"

The Gage county officials all hold over this year with the exception of the district clerk whose term extends to next year.
