YOUNG'S CASE IN COURT.

Arguments Will Be Filed in the Case Against Former State Binder.

Special to Times-Republican.

Des Moines. Sept. 4--Arguments in the case of the state of Iowa vs. Lafayette Young, of this city, for overcharging the state of Iowa while he occupied the position of state binder are to be filed soon, it is understood, with the clerk of the supreme court. The case was heard in the Polk county district court and the decision of the court was that aside from the case of the overcharging, the money had been paid by a state official as the agent for the state, and hence there could be no recovery. That is the question of whether or not there was an overcharge to the amount of about $5,000, was not settled by the court. The attorneys for Mr. Young argued that even if there was an overcharge the state had, thru its agent, George L. Dobson, then secretary of state, paid the money, and by so doing recognized the charge as being right, and hence could not recover, By so arguing and by convincing the court that this was the right view of the matter. they prevented the case coming before the court on its merits so as to settle the question of whether or not there was any overcharge. The case is on the docket and is expected will soon be argued.
