WHEELING. December 31.

A few days ago, Dr. Cummings, of the Mississippi territory, who had been at Richmond as a witness for Burr, left this place on his way home. He stated that Burr would not appear in person at the Circuit Court of the United States, which is to sit at Chillicothe next week; that the witnesses were not bound at Richmond to appear at Chillicothe, and neither the United States nor the accused could be ready for the trial.

Burnett, Esq. of Cincinnati, is to appear as counsel for Burr.
