A Decision Rendered Against the Defendant-Declared Null and Void.
San Francisco, Dec. 26.
In the United States Circuit Court, Judge Sawyer this morning rendered a decision in favor of the plaintiff in the suit of Sharon vs. Hill, brought to declare void the alleged marriage contract. The decision refers to the refusal of the defendant to produce the alleged marriage contract before the examiner, and directs her committal for contempt.
The decision adds: "This singular conduct can only be interpreted as an admission that such an inspection would tend to prove the claim of marriage contract a falsity."
The decision then states that the principal question was whether the alleged declaration of marriage was genuine or forged. It also holds, from the same testimony, that the word "wife" in the "my dear wife" letter is a tracing substituted for another word. The opinion concludes by stating that the alleged marriage contract is a forgery, and declares it to be null and void. The main opinion is by Judge Deadle of the United States District Court of Oregon. Judge Sawyer filed a concurring opinion. The action was brought by the late Wm.
